PVC pipe maker Modern Products Industries Inc. has filed a patent infringement lawsuit against building products house CertainTeed Corp.
The suit involves Modern's Shur-Align PVC well casing and drop pipe. Shur-Align is Modern's primary product, said officials from the Beeville, Texas, firm. Modern received its patent Dec. 23, and filed suit the same day in U.S. District Court in Corpus Christi.
CertainTeed's product is trademarked as Kwik-Set.
Valley Forge, Pa.-based CertainTeed said it disputes the infringement claim.
``CertainTeed believes that the suit is without merit and the company intends to vigorously defend our position,'' spokesman Bill Seiberlich wrote in a Jan. 12 e-mail.
