DEERFIELD, ILL. — Pregis Corp. has filed a patent infringement suit against Sealed Air Corp. of Elmwood Park, N.J., in the U.S. District Court for Delaware.
Pregis subsidiary Pregis Innovative Packaging Inc. charged Sealed Air with infringement of its Laminate Film Foam Flooring Composition U.S. Patent Nos. 6, 607, 803; 7,047,705; and RE38,745. The patents were issued in 2003, 2005 and 2006.
“Pregis has expanded significant investment to develop its flooring underlayment technology. We will vigorously protect our intellectual property against unauthorized manufacture, sale, installation, or use of film-foam flooring systems that are covered by Pregis patents,” said Tom Wetsch, vice president of new product development at Pregis, in a news release.
In court records, Deerfield-based Pregis said Sealed Air manufactured and sold the product to Home Depot and other distributors. It also alleged that the company offered the product as a direct replacement for the Pregis product.
Sealed Air did not respond to a call for comment.
